Welcome to The Performance Club ("we," "us," or "our"), a personal fitness and nutrition coaching service operated by Ana Caccavale. By accessing our website, completing our onboarding or application forms, or purchasing any coaching service, you ("you" or "the client") agree to these Terms of Service. Please read them carefully.

1. Services

We provide personalized fitness coaching, nutrition guidance, training programs, and related accountability services, delivered online and/or in person. The specific services, duration, and deliverables are described at the time of purchase or in your coaching agreement. Coaching is educational and motivational in nature and is not a substitute for professional medical care.

2. Eligibility

You must be at least 18 years old to purchase our services. By using our services you represent that the information you provide, including in the onboarding form, is accurate and complete to the best of your knowledge.

3. Client responsibilities

• Obtain clearance from a licensed physician before beginning any new exercise or nutrition program.
• Disclose any injuries, medical conditions, medications, or limitations that may affect your participation.
• Follow programming at your own pace and stop any activity that causes pain, dizziness, or distress.
• Communicate honestly and promptly so we can adjust your program appropriately.

4. Payment

Fees, billing schedules, and refund eligibility are described in our Payment & Cancellation Policy, which forms part of these Terms.

5. Intellectual property

All programs, materials, videos, and content we provide are our intellectual property and are licensed to you for your personal, non-commercial use only. You may not copy, resell, redistribute, or share them without our written permission.

6. Assumption of risk

Physical exercise carries inherent risks, including injury. By participating you voluntarily assume all such risks. Please review our Health Disclaimer and Results Disclaimer.

7. Limitation of liability

To the fullest extent permitted by law, The Performance Club and Ana Caccavale shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount you paid for the service giving rise to the claim.

8. Changes to these terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles.
