Organized by The Performance Club ("TPC"). In this agreement, "Released Parties" means TPC, its owners, coaches, staff, contractors and volunteers, the venue and its owners, and the event's brand partners.

1. 01

   Voluntary participation

I am choosing to attend Sculpt & Social voluntarily. The event includes an outdoor full-body sculpt (fitness) class, an optional cold plunge, food and beverages, brand activations and social activities.

2. 02

   Health and fitness

I confirm that I am in good health and know of no medical condition that would make it unsafe for me to exercise or use a cold plunge. I understand I should consult a physician before any exercise or cold-water immersion, especially if I am pregnant or have a heart, blood-pressure, respiratory or circulatory condition. I will modify or stop any activity and alert staff if I feel pain, dizziness, shortness of breath or discomfort.

3. 03

   Assumption of risk

I understand that exercise and cold-water immersion involve inherent risks, including but not limited to muscle strains, sprains, falls, cold shock, hypothermia, fainting, cardiac events, allergic reactions and, in rare cases, serious injury or death. Outdoor conditions such as heat, sun, weather and uneven surfaces add further risk. I knowingly and voluntarily assume all of these risks, whether known or unknown.

4. 04

   Cold plunge

The cold plunge is optional. If I use it, I will follow staff instructions, limit my time in the water, and not use it after consuming alcohol.

5. 05

   Release of liability

To the fullest extent permitted by Florida law, I release, waive and discharge the Released Parties from any and all claims, demands and causes of action for injury, illness, death, or loss or damage to property arising out of or related to my attendance or participation, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES. This release does not apply to gross negligence or intentional misconduct.

6. 06

   Indemnity

I agree to indemnify and hold harmless the Released Parties from any claim brought by me, on my behalf, or by any guest for whom I purchased a ticket, arising from that person's attendance or participation.

7. 07

   Medical treatment

I authorize event staff to obtain emergency medical treatment for me if needed, and I accept responsibility for its cost.

8. 08

   Food, drinks and products

I am responsible for my own food allergies and dietary needs. Products offered by brand partners are provided by those third parties. If alcohol is served, only guests 21+ with valid ID may drink, and I agree to drink responsibly.

9. 09

   Photo and video consent

I understand the event will be photographed and filmed. I grant TPC the right to use photos, video and audio of me taken at the event on its website, social media and marketing, without compensation. If I prefer not to be featured, I will tell the team at check-in.

10. 10

    Personal property

The Released Parties are not responsible for lost, stolen or damaged personal belongings.

11. 11

    Conduct

I will follow staff instructions and venue rules. TPC may remove anyone behaving in an unsafe or disruptive way, without a refund.

12. 12

    Tickets

All ticket sales are final and non-refundable. The event takes place rain or shine; if weather requires it, the experience may move indoors and ticket holders will be notified by email. If TPC cancels the event, the ticket price will be refunded.

13. 13

    Guests

If I purchase tickets for other people, I confirm that each guest is 18 or older, that I have shared these terms with them, and that they agree to be bound by them.

14. 14

    Age

I confirm that I am 18 years of age or older.

15. 15

    Governing law

This agreement is governed by the laws of the State of Florida, with venue in Broward County. If any part of it is found unenforceable, the rest remains in effect.
